Arizona Fraud Schemes Attorneys

Protecting You in the Face of Serious Penalties

Under Arizona law, someone charged with what is commonly referred to as “fraudulent schemes” under A.R.S. 13-2310 is accused of creating a scheme or artifice to defraud and knowingly obtaining any benefit by means of false or fraudulent pretenses, representations, promises, or material omissions. A “scheme or artifice” includes a scheme to deprive a person of the intangible right of honest services.

We have helped thousands of clients in Tempe, Phoenix, Scottsdale, Mesa, and throughout Arizona, and we are prepared to fight for you, too. Possible Punishments for Fraud Schemes

If you are facing fraudulent schemes charges, you also face a number of serious and harsh penalties. These penalties will depend on the nature of your charges, as well as the surrounding circumstances and other outside factors.

The possible penalties for fraud schemes in Arizona include:

  • First offense: probation with up to 1 year in jail; if prison is ordered, between 3 years and 12 years, 6 months in prison
  • One historical prior felony conviction: between 4 years, 6 months and 23 years, 3 months in prison
  • Two historical prior felony convictions: between 10 years, 6 months and 35 years in prison

Additionally, if the amount of the benefit received by the defendant is valued at $100,000 or more, the court must sentence the defendant to prison; probation is not available.

Possible Defenses to Fraud Scheme Charges

There are a number of defenses available to someone charged with fraudulent schemes. Depending on your exact circumstances, our Arizona fraud scheme defense attorneys may be able to work to prove that you lacked intent to defraud, unknowingly obtained benefits under false pretenses, or were unwittingly involved in a fraudulent scheme. Each case is unique and will require a different, tailored approach. In every case, however, our attorneys work together to pool their resources, insights, and extensive legal knowledge. This allows them to build solid legal strategies aimed at achieving the best possible outcome for your unique case.
