Under Arizona law, someone charged with what is commonly referred to as “fraudulent schemes” under A.R.S. 13-2310 is accused of creating a scheme or artifice to defraud and knowingly obtaining any benefit by means of false or fraudulent pretenses, representations, promises, or material omissions. A “scheme or artifice” includes a scheme to deprive a person of the intangible right of honest services.

Arizona Fraud Scheme Penalties
If you are facing fraudulent schemes charges, you also face a number of serious and harsh penalties. These penalties will depend on the nature of your charges, as well as the surrounding circumstances and other outside factors.
The possible penalties for fraud schemes in Arizona include:
- First offense: probation with up to 1 year in jail; if prison is ordered, between 3 years and 12 years, 6 months in prison
- One historical prior felony conviction: between 4 years, 6 months and 23 years, 3 months in prison
- Two historical prior felony convictions: between 10 years, 6 months and 35 years in prison
Additionally, if the amount of the benefit received by the defendant is valued at $100,000 or more, the court must sentence the defendant to prison; probation is not available.
