If a person's blood alcohol concentration is .20 or above!
What Is Super Extreme DUI in Arizona?
Under ARS 28-1382(A)(2) it is unlawful for a person to drive or be in actual physical control of a vehicle in Arizona if the person has an alcohol concentration above .20 within 2 hours of driving or being in actual physical control of a vehicle. This is commonly referred to as a Super Extreme DUI.
A first and second offense Super Extreme DUI is a Class 1 Misdemeanor, punishable with up to 5 years probation, $5,000.00 in fines, court fees, 6 months in jail, court ordered substance abuse counseling, and any other term as ordered by the judge. In addition, Arizona law requires the judge to impose the following minimum sentence for a person convicted under this statute:
First Offense Super Extreme DUI AZ
- Mandatory minimum 45 days in jail;
- Mandatory minimum $3,200 in fines;
- Jail fees and other court fees;
- Mandatory court ordered substance abuse counseling.
Second Offense Super Extreme DUI AZ
- Mandatory minimum 180 days in jail;
- Mandatory minimum $4,000 in fines;
- Jail fees and other court fees;
- Mandatory court ordered substance abuse counseling.
In addition to the above mandatory court penalties, MVD will suspend your license and require that you complete traffic survival school prior to getting your driving privileges back. Once you are allowed to drive again you will also be required to equip your vehicle with the ignition interlock device.
