Cultivation of Marijuana Penalties in Arizona
If the amount of marijuana produced has a dried weight of less than 2 pounds, it is considered a Class 5 felony.
This comes with the following potential punishments:
- For a first offense, probation with up to 1 year in county jail. If prison is ordered by the judge, it will be 6 months to 2.5 years
- If you have one historical prior felony conviction, the punishment is 1 to 3.75 years in prison
- If you have two historical prior felony convictions, the punishment can be 3 to 7.5 years in prison
If the amount produced has a dried weight of two to four pounds, it is a Class 4 felony with the following potential punishments:
- First offense: Mandatory 1 to 3.75 years in prison
- Second offense: 2.25 to 7.5 years in prison
- Third offense: 6 to 15 years in prison
If the amount produced has a dried weight of over four pounds, it is a Class 3 felony with the following penalties:
- First offense: 2 to 8.75 years in prison
- Second offense: 3.5 to 16.25 years in prison
- Third offense: 7.5 to 25 years in prison
